Terms & Conditions/ Photo Consent
Please read our Terms and Conditions (“the Terms”) carefully before booking classes or services. By booking a class or signing up for a membership, at the end of this document you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed below, constitute a contract of membership between you (the client) and us (Namaste Yoga and Wellness Center). Please ensure that you read and understand before attending any class at the studio.
INTRODUCTION
All classes, activities and workshops are supplied by Namaste Yoga and Wellness Center LLC (238 Taunton Blvd., Ste. 3, Medford, NJ 08055) subject to the following Terms. In these Terms “we”/”us”/”our” means Namaste Yoga and Wellness Center LLC. And “you”/”your”/”yours” means you, the direct client.

NAMASTE YOGA AND WELLNESS CENTER TERMS & CONDITIONS ARE AS FOLLOWS:

BOOKING CLASSES: Classes should be pre-booked online by visiting our website and following the prompts from our online schedule or downloading the Mindbody app and registering for Namaste Yoga and Wellness Center classes on the app. Walk-ins are accepted on a first come, first serve basis.

ALL CLASS BOOKINGS AND SERVICE BOOKING SALES ARE FINAL: We do not offer refunds for classes, packages, memberships or workshops purchased by mistake or for any other reasons. However, if your plans change and you need to cancel a reservation, you can still use the class credit as long as your cancellation is prior to two hours before the class start time.

CANCELING YOUR BOOKING: You may cancel a booking without cancellation fees and loss of class credit prior to (2) two hours before the class starts. You can cancel your booking by logging into your Mindbody account and following the steps to cancel. You can also call the studio at (856) 446-6233 or email namasteyoganj@gmail.com.

LATE CANCELLATIONS: A Late Cancellation is a cancellation made later than 2 hours before class. Late cancellations may result in either a loss of one class credit on a single class or class package or a $15 charge for those on a membership (after 3 misses).

LATE ARRIVALS: For safety reasons, the door will be locked 10 minutes into the start of class. Therefore, late arrivals are not guaranteed participation in the class.

NO SHOWS: A no show is a pre-registered student that did not attend class and did not early cancel for the class. No shows result in either a loss of class credit for those on class packages OR a $15 charge for students on memberships and monthly options.

BOOKING CLASSES: Classes are open for booking online one month ahead. Classes can also be booked by calling the studio at (856) 446-6233 or emailing namasteyoganj@gmail.com.

SINGLE CLASS BOOKINGS: All single-class passes have no expiration date. This includes First Time 3/ $30 Drop In, Regular Drop In, and 12 Class Pack.

MONTHLY CLASS SUBSCRIPTION EXPIRATIONS: All monthly class subscriptions have expiration dates one month from the time of purchase. You can purchase a 4 Class Monthly subscription or an Unlimited Class Monthly subscription online or in person at Namaste Yoga and Wellness Center. The activation date begins on the date of purchase (example: 9/10), expires one month later (example: 10/9), and auto-renews the day after expiration (example: 10/10). Any unused credits will expire after the subscription period ends, and when renewed, credits will refresh. Passes cannot be suspended or extended but they can be transferred to someone else and still must be used by the expiration date.

IF WE CANCEL A CLASS OR EVENT: In the event that we cancel a class or event that you have already booked, we will contact you by email, phone call, or text to let you know. At the time of cancellation, we will offer you the choice between 1. crediting your Namaste Yoga and Wellness Center account with the price of the canceled class; or 2. being transferred to a class at an alternative date and time.

CHANGE OF PRICES: We reserve the right to review and change the price of our classes and memberships at our sole and absolute discretion.

PAYMENT: Classes and packages may be paid for via cash, Apple Pay, credit or debit card. A credit card must be on file for students on the subscription (4 Class, Unlimited) membership types. Payment for unlimited monthly auto-pay memberships must be made by a debit or credit card placed on file for billing. If you sign up for a membership, you must pay your first month's payment upfront. Your membership fees will then be payable each month of your contract period and will become due on the same date each month, which may vary depending on the date you signed up.

MONTHLY UNLIMITED MEMBERSHIP TERMS: By signing up for the Unlimited Classes Membership, you agree to the following: Placing your credit card on file for first month’s payments and all future auto payments and late cancellation or no-show fees. This membership does not require a long-term commitment and can be canceled or changed with a minimum of 3-days notice BEFORE your next billing date. If you wish to cancel or change your membership, you will need to give written notice (namasteyoganj@gmail.com) to cancel. Namaste Yoga and Wellness Center is in no way, under any circumstances, responsible or obligated to pay for member’s insufficient fund penalties and/or over the limit fees.

NON-PAYMENT OF FEES: Namaste Yoga and Wellness Center is in no way, under any circumstances, responsible or obligated to pay for member’s insufficient fund penalties, returned checks, and/or over the limit fees. If your account becomes overdue, we reserve the right to refuse you entry into our studio/classes/workshops until the overdue sums are paid in full. Should you default on payments to us, we reserve the right to notify the default to a credit reference agency or other third party to obtain payment from you.

WELFARE OF STUDENTS AND STAFF: Namaste Yoga and Wellness Center is committed to the safety and welfare of yoga students and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior. Namaste Yoga and Wellness Center has the right to judge behavior and respond accordingly. This right includes, but is not limited to termination of membership and/or cancellation of class passes without refund of any student engaging in unacceptable behavior. Yoga students who do not observe Namaste Yoga and Wellness Center policies or who abuse equipment in any fashion will be asked to leave. Namaste Yoga and Wellness Center reserves the right to terminate memberships or class passes of anyone who refuses to observe any of Namaste Yoga and Wellness Center rules. Not all rules are listed in these terms, see Equal Rights Policy, Anti Harassment Policy, and Grievance Policy. Copies of these policies can be found in studio or online.

FORCE MAJUEURE: We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labor, fuel, parts or machinery, power failure or breakdown in machinery.

WAIVER: No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.

SEVERABILITY: If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

ENTIRE AGREEMENT: These Terms constitute the entire agreement between the parties and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between parties.

GOVERNING LAW AND JURISDICTION: These Terms shall be governed by and construed in accordance with New Jersey law and the parties hereby agree to submit the exclusive jurisdiction of New Jersey.

CHANGES: Namaste Yoga and Wellness Center reserves the right to add, change, or remove rules and conditions of participation in classes or membership.

VIDEOGRAPHY NOTICE: A video surveillance system has been installed for the purposes of security for the premises. If a student wishes to stay out of the video frame, it is their responsibility to inform the instructor or studio support before class to switch to another mat spot.

PHOTOGRAPHY NOTICE/ Consent: Namaste Yoga and Wellness Center may record studio activity for our marketing and social media content. By signing below, you agree to our Photograph Consent Form.

Namaste Yoga and Wellness Center (“we”/ “our”) takes great pride in being able to illustrate its culture and people in our efforts to market the company’s services to our growing client base. Whenever possible, we include photos of our community (clients/staff). For that reason, we request in advance your permission to include you in photographs we may take in our marketing efforts to illustrate our company and the services we provide.

I do hereby give Namaste Yoga and Wellness Center, consent to use my photograph(s) for reproduction in any medium including but not limited to print and electronic (i.e. internet) for purposes of advertising, trade, display, exhibition or editorial use.

I hereby waive any right that I may have to inspect and approve the finished product or copy that may be used in connection with an image that the photographer has taken of me or the use to which it may be applied.

I further acknowledge that I will not be entitled to payment or any sort of charge for such action.

Upon the usage of my photographs, I consent to such materials being the sole property of Namaste Yoga and Wellness Center and that I will no longer be entitled to them, provided it is done for lawful purposes.

I hereby release all rights to any, but limited to, claims, rights, demands, and/ or any causes of action by me or my representatives, heirs, or anyone else.

DATA PROTECTION NOTICE: We, Namaste Yoga and Wellness Center, will use your personal details and information to provide you with use of our services and facilities, to administer and maintain our membership records, to process your application and payments, and to verify your identity. We may keep your information for a reasonable period for these purposes. We will not share your information with anyone outside of Namaste Yoga and Wellness Center or your designated emergency contact. If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how we use your information, please let us know by contacting namasteyoganj@gmail.com. You hereby consent to the use of your information, including sensitive personal data relating to your health and fitness, for the reasons and in the manner set out above. Please see the Confidentiality Policy for more information.

LOST OR STOLEN ITEMS: Namaste Yoga and Wellness Center is not responsible for the safekeeping of any personal items and not responsible for any lost, stolen or left behind items.

POLICY ACCEPTANCE: By using Namaste Yoga and Wellness Center services, attending any classes, or workshops, you agree to the Terms and Conditions & Photography Consent as stated above.
